Entry/Redemption Method | 1. During the Contest Period, purchase any one (1) of the following promotional pack (“Promotional Pack”):
from any offline outlets or online platforms. 2. Upon purchasing the Promotional Pack, look for a 6-digits code (“Promotional Code”) on the pack. 3. Go to the website at https://www.nestle-cereals.com/minions2 and access the Contest homepage. 4. When requested, key in the Promotional Code and enter the required information [full name, contact number, date of birth (optional), e-mail address, address] in order to submit the Contest entry. 5. Following your submission, you will receive an instant on-screen notification of whether you have won a prize. 6. The winner will receive a confirmation email within fourteen (14) working days from the date of notification of the win.In order to qualify for the prizes, the winner must reside in the same country from where they purchased the Promotional Pack and submitted the Contest entry.Only one (1) entry is allowed for each participant per day. Participant may re-participate the Contest platform after 24 hours with the same code. |
Entry/Redemption Deadline | All entries must be received by the Organiser on or before 11:59 on 31st December 2020. Any submissions received after the contest deadline will be disqualified. |
Judging details | The Organiser has made all prizes available to be won by setting each prize to a designated time throughout the Contest Period.The participant who submits his/her Promotional Code at such designated time will automatically be chosen as the winner. Once a participant has won one (1) prize, the participant will no longer be eligible to participate in the Contest. Any submission of new entry with the same personal details will be automatically disqualified. |
Prizes | A total of One thousand and eight hundred (1800) Prizes, 1000 Minions Backpack and 800 Minions Microbus Containers will be given out to the selected winners.In the exit screen, the winners will be notified they are winners and the prize will be given through {myGift} variable which will display the won gift. The prizes are non-exchangeable, non-transferable, and is not redeemable for cash or other prizes. |
Prize Claim/Delivery Date | The prizes will be delivered to the given mailing address that is given by the selected winners within ninety (90) days after the email notification has been sent to the winner. The Organiser will inform the winner and collect the required details including name, contact details, mailing address to ensure a smooth process of the delivery of the prize. In the case whereby the personal details of the selected winners are not provided within fourteen (14) days after the email notification has been sent to the winner, such winner will be disqualified. Participants must retain their original proof of purchase to verify their purchase. The Organiser shall reserve the right to request for further evidence in the processing of the contest entry including the identification documents for verification prior to the delivery of the Prizes. Failure to produce any of the foregoing documents within the stipulated timeframe will result in disqualification and forfeiture of the Prizes. |
Additional Terms | Promotional Code: The Promotional Code must be entered online exactly as they appear (case-sensitive) on the Promotional Pack. The use of codes from non-promotional packs, or the use of any Promotional Code not intended for use in this Contest may result in disqualification and any such entry will be being declared void. If you are unable to read your Promotional Code due to a genuine printing error, you can contact our customer service. Any request for a replacement Promotional Code must be received by the Organiser no later than 25th December 2020. If genuine, a replacement Promotional Code will be sent to you. For avoidance of doubt, the Organiser shall not assume any responsibility for any Promotional Code that is damaged or defaced resulting from the manner of how the product packaging is opened.Defects in the prizes The Organiser is not liable for any defects in the Prizes, and all complaints with the Prizes should be directed towards the manufacturer of the Prize. |
This Schedule to Conditions of Entry must be read together with the following Conditions of Entry, collectively “Terms and Conditions”, and shall be binding on all Participants (and the parent/legal guardian of the participant, in the case of a minor participant) who participate in this Contest (hereinafter referred to as “Participants”, “Participant”, “You”, “you”, “your”).
B: Conditions of Entry
1. Introduction
1.1 This Conditions of Entry is to be read together with the Schedule to Conditions of Entry. To the extent that there is any inconsistency between the Conditions of Entry and the Schedule to Conditions of Entry, the Schedule to Conditions of Entry prevails. The Conditions of Entry and the Schedule to Condition of Entry shall collectively be referred to as the “Terms and Conditions”. Each capitalized term not otherwise defined herein shall have the meaning ascribed to such term in the Schedule to Conditions of Entry. Defined terms will be used singular or plural as the case may be.
1.2 The Organiser reserves the right in its sole discretion, without prior notice, and without any liability to any person, at any time to change the Terms and Conditions including to change the Contest Period, make Payment substitutions, cancel, terminate or suspend the Contest in whole or in part. In the event of any changes to the Terms and Conditions, Participants agree that their continued participation in the Contest will constitute their acceptance of the Terms and Conditions (as changed).
1.3 The Organiser’s decision on all matters relating to the Contest including judging and selection of winners will be final, binding and conclusive on all Participants, and no correspondence or appeals will be entertained.
2. Contest Entries
2.1 By submitting an entry to the Contest, Participants are deemed to have understood and agreed to be bound by the Terms and Conditions.
2.2 All costs and expenses incurred and/or arising from the participation in the Contest, including without limitation, telecommunications, network, Short Messaging Services, postal and all such other charges and out-of-pocket expenses as may be incurred by a Participant during or in connection with the Contest shall be borne by the Participant.
2.3 Proof of submission of an entry is not proof of receipt, and the Organiser shall not be liable for any delay, lost, damaged and/or non-receipt of submissions. The Organiser is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of our telecommunications network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet.3. Eligibility
3.1 Where the eligibility age prescribed in the Schedule to Conditions of Entry is below the age of eighteen (18), Participants are required to obtain the written consent (in such form as may be prescribed by the Organiser), from their parents/legal guardians before participating in the Contest and submitting any personal information.
3.2 The Organiser may require a Participant to provide proof of eligibility to participate in the Contest including without limitation, identification documents, and the written consent of parents/legal guardians in the case of Participants below the age of eighteen (18) years.
4. Ineligibility
The following groups of persons shall not be eligible to participate in the Contest:
(a) employees of the Organiser and its group of companies and their immediate family members (spouse, children, parents, siblings, and their spouses); and
(b) employees of the Organiser’s agencies associated with the Contest and their immediate families (spouse, children, parents, siblings, and their spouses).
5. Disqualification
5.1 The following entries will be disqualified:
(b) unclear, incomplete, duplicate, copies, illegible or incorrect entries; and/or
(b) entries that violate the Terms and Conditions, any applicable laws and/or regulations.
5.2 In addition, the Organiser reserves the right to disqualify any Participant that:
(a) undermines, has or attempted to undermine the operation of the Contest by fraud, cheating or deception; and/or
(b) are not eligible or unable to provide proof of eligibility to participate in the Contest for verification by Organiser when requested.
5.3 In the event of a disqualification after a Prize has been awarded, the Organiser reserves the right to demand for the return of the Prize or payment of its value from the disqualified Participant.
6. Prizes
6.1 The Organiser, its agents, sponsors and representatives shall have no liability to any Participant who defaults in collecting the Prizes in accordance with the Prize redemption in any respect whatsoever. The Organiser reserves the right to determine how uncollected Prizes will be dealt with.
6.2 Prizes are strictly not transferable, assignable, exchangeable or redeemable by the Participant in any other form or manner other than that specified by the Organiser.
6.3 Any additional costs not specifically stated in the Schedule to Conditions of Entry in relation to a Prize shall be the responsibility of the Participant.
6.4 All Prizes must be taken according to the terms and conditions of the Organiser, its agent. sponsor or third party providing the Prizes.
6.5 Prize(s) are given out on an “as it is” basis. The Prize shall be used/taken entirely at the risk of the Participants and the Organiser excludes all warranties and liabilities in connection with the Prize to the fullest extent permitted by law.
6.6 Prizes must be claimed in person unless the Organiser prescribes other modes of collection.
6.7 Where a Participant is under the age of 18 years of age and is declared a Prize winner, the Participant must be accompanied by their parent/legal guardian throughout the Prize fulfilment.
7. Publicity
The Organiser may use a Participant’s entry including without limitation, photos, drawings, text, and any other content or information submitted for purposes of the Contest (collectively the “Materials”), and the Participant’s name, and/or likeness, for advertising, publicity and Contest of any goods or services of the Organiser, for an unlimited time throughout the world without compensation, and in any media. The Participant shall do all things necessary to give effect to this if requested by the Organiser.
8. Intellectual Property Rights
The Participant agrees that all intellectual property rights in any contents and/or materials submitted, made or created by the Participant in connection with the Contest and any derivative works arising therefrom will perpetually and unconditionally be vested in, assigned to and owned by the Organiser. The Organiser has the right to use and modify such materials or works in any way it deems fit without compensation to the Participant and the Participant waives all rights he or she may have in such materials or works.
9. Indemnity
Each Participant agrees to indemnify, release and hold harmless each of the Organiser, its holding, subsidiary or related companies as defined in the Companies Act 2016 (“Nestlé Malaysia Group”), directors, officers, employees, agents, sponsors and/or representatives against any and all losses, rights, claims, actions and damages (including special, indirect and consequential damages) arising from or incurred as a result of the Participant’s participation in the Contest, acceptance of any Prize, and/or the use of the Participant’s entry and/or likeness in connection with the Contest or violation of the Terms and Conditions.
10. Limitation of Liability
10.1 The Participant’s participation in the Contest shall be at the Participant’s own risk.
10.2 The Organiser, Nestlé Malaysia Group, its, directors, officers, employees, agents, sponsors and/or representatives shall not be liable to any Participant in respect of any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained by the Participant arising out of or in connection with the participation by the Participant in the Contest, as well as the redemption and/or utilisation of any Prize won.
11. General
11.1 The Organiser, its agents, sponsors and/or representatives shall not be liable to perform any of their obligations in respect of the Contest and the Terms and Conditions where they are unable to do so as a result of circumstances beyond their control and shall not be liable to compensate the Participants in any manner whatsoever in such circumstances.
11.2 Any names, trademarks or logos used and or reproduced in any materials (including marketing and Promotional materials) in connection with this Contest, in particular that relates to the Prize, are the properties of their respective owners. This Contest and the Organiser are not affiliated with, or endorsed or sponsored by, the relevant owners, unless otherwise communicated, and such owners are not part of the Organiser’s group of companies.11.3 The Participants shall not be entitled to assign any of the rights or sub-contract any of the obligations herein. The Organiser shall be entitled to assign or sub-license the whole or any part of its rights hereunder to any third party as may be determined by the Organiser.
11.4 The invalidity, illegality or unenforceability of any terms hereunder shall not affect or impair the continuation in force of the remainder of the Terms and Conditions of the Contest.
11.5 Where the Terms and Conditions of the Contest is prepared in English and any other language(s) in the event of any inconsistency between the English language and the other language(s), the English language version shall prevail and govern in all respects.
11.6 The Terms and Conditions of the Contest shall be construed, governed and interpreted in accordance the laws of Malaysia.
12. Privacy Notice
12.1 By participating in the Nestlé Breakfast Cereals Kids Minions 2 Contest, the Participant agrees to the processing of the Participant’s Personal Data by the Organizer in accordance with the Privacy Notice in https://www.nestle.com.my/info/privacy_notice .

1. Sources of personal data
This Notice applies to Personal Data that We collect from or about you, through the methods described below (see Section 2), from the following sources:
Nestlé websites. Consumer-directed websites operated by or for Nestlé, including sites that We operate under our own domains/URLs and mini-sites that We run on third party social networks such as Facebook or Instagram (“Websites”).
Nestlé mobile sites/apps. Consumer-directed mobile sites or applications operated by or for Nestlé, such as smartphone apps.
E-mail, text and other electronic messages. Interactions with electronic communications between you and Nestlé.
Nestlé CES. Communications with our Consumer Engagement Centre (“CES”).
Offline registration forms. Printed or digital registration and similar forms that We collect via, for example, postal mail, in-store demos, points of sale, campaigns, contests and events.
Advertising interactions. Interactions with our advertisements (e.g., if you interact with on one of our ads on a third party website, We may receive information about that interaction).
Data We create. In the course of our interactions with you, We may create Personal Data about you (e.g. records of your purchases from our Websites).
Data from other sources. Third party social networks (e.g. such as Facebook, Google), market research (if feedback not provided on an anonymous basis), third party data aggregators, Nestlé promotional partners, public sources and data received when We acquire other companies.

2. Personal data that we collect about you and how we collect it
Depending on how you interact with Nestlé (online, offline, over the phone, etc.), We collect various types of information from you, as described below.
Personal contact information. This includes any information you provide to Us that would allow Us to contact you, such as your name, postal address, e-mail address, social network details, or phone number
Account login information. Any information that is required to give you access to your specific account profile. Examples include your login ID/email address, screen name, password in unrecoverable form, and/or security question and answer.
Demographic information & interests. Any information that describes your demographic or behavioural characteristics. Examples include your date of birth, age or age range, gender, geographic location (e.g. postcode/zip code), favourite products, hobbies and interests, and household or lifestyle information.
Information from computer/mobile device. Any information about the computer system or other technological device that you use to access one of our Websites or apps, such as the Internet protocol (IP) address used to connect your computer or device to the Internet, operating system type, and web browser type and version. If you access a Nestlé website or app via a mobile device such as a smartphone, the collected information will also include, where permitted, your phone’s unique device ID, advertising ID, geo-location, and other similar mobile device data.
Websites/communication usage information. As you navigate through and interact with our Websites or newsletters, We use automatic data collection technologies to collect certain information about your actions. This includes information such as which links you click on, which pages or content you view and for how long, and other similar information and statistics about your interactions, such as content response times, download errors and length of visits to certain pages. This information is captured using automated technologies such as cookies and web beacons, and is also collected through the use of third party tracking for analytics and advertising purposes. You have the right to object to the use of such technologies, for further details please see Section 4.
Market research & consumer feedback. Any information that you voluntarily share with Us about your experience of using our products and services.
Consumer-generated content. Any content that you create and then share with Us on third party social networks or by uploading it to one of our Websites or apps, including the use of third party social network apps such as Facebook or Instagram. Examples include photos, videos, personal stories, or other similar media or content. Where permitted, We collect and publish consumer-generated content in connection with a variety of activities, including contests and other promotions, website community features, consumer engagement, and third party social networking.
Third party social network information. Any information that you share publicly on a third party social network or information that is part of your profile on a third party social network (such as Facebook) and that you allow the third party social network to share with Us. Examples include your basic account information (e.g. name, email address, gender, birthday, current city, profile picture, user ID, list of friends, etc.) and any other additional information or activities that you permit the third party social network to share. We receive your third party social network profile information (or parts of it) every time you download or interact with a Nestlé web application on a third party social network such as Facebook, every time you use a social networking feature that is integrated within a Nestlé site (such as Facebook Connect) or every time you interact with Us through a third party social network. To learn more about how your information from a third party social network is obtained by Nestlé, or to opt-out of sharing such social network information, please visit the website of the relevant third party social network.
Payment and Financial information. Any information that We need in order to fulfil an order, or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available). In any case, We or our payment processing provider(s) handle payment and financial information in a manner compliant with applicable laws, regulations and security standards.
Calls to Consumer Engagement Services. Communications with a CES can be recorded or listened into, in accordance with applicable laws, for local operational needs (e.g. for quality or training purposes). Payment card details are not recorded. Where required by law, you will be informed about such recording at the beginning of your call.
Sensitive Personal Data. This includes information about your physical or mental health or condition and your religious beliefs. Where it becomes necessary to process your sensitive personal data for any reason, We rely on your prior express consent for any processing which is voluntary (e.g. for marketing purposes). If We process your sensitive personal data for other purposes, we rely on the following legal bases: (i) detection and prevention of crime (including the prevention of fraud); and (ii) compliance with applicable law (e.g. to comply with our diversity reporting).
Photographs or Videos. This includes photographs or videos of you taken or recorded during Nestlé On Ground Events
3. Personal data of children
We do not knowingly solicit or collect personal data from children below the age of 18. If We discover that we have unintentionally collected personal data from a child below 18, We will remove that child’s personal data from our records promptly. However, Nestlé may collect personal data about children below the age of 18 years of age from the parent or guardian directly, and with that person’s explicit consent. In these situations, you confirm that they have appointed you to act for them and to consent on their behalf to processing their personal data in accordance with this privacy notice.

In addition to the Nestlé entities mentioned in the data controllers & contact section (see Section 12), We share your Personal Data with the following types of third party organisations:Service providers. These are external companies that We use to help Us run our business (e.g. order fulfilment, payment processing, fraud detection and identity verification, website operation, market research companies, support services, promotions, website development, data analysis, CRC, etc.).
